If the facility does not employ a qualified professional person to furnish a specific service to be provided by the facility, the facility must have that service furnished to residents by a person or agency outside the facility under an arrangement described in section 1861(w) of the Act or an agreement described in paragraph (h)(2) of this section. Arrangements as described in section 1861(w) of the Act or agreements pertaining to services furnished by outside resources must specify in writing that the facility assumes responsibility for obtaining services that meet professional standards and principles that apply to professionals providing services in such a facility; and the timeliness of the services.

Based on record review and staff interviews during the recertification survey, the facility did not ensure that information requested by a Dialysis Center on four different occasions was provided timely for one of three residents reviewed for dialysis in a total sample of thirty. This resulted in no actual harm with potential for more than minimal harm that is not immediate jeopardy. (Resident #13)
The finding is:
Resident #13 has diagnoses that include End Stage Renal Disease and receives Kidney Dialysis three times a week.
The Dialysis Service composition book that was utilized for communication between the facility and the Dialysis Center revealed the following for Resident #13:
1) 9/14/10 The Dialysis Center Dietician documented that she needed a 24 hour diet recall (a resident's food and fluid intake for twenty-four hours/calorie count).
2) 10/12/10 The Dialysis Center Dietician's note stated, "can I please have a calorie count (refer to note on 9/14/10)."
3) 10/19/10 The Dialysis Center Dietician's note stated, "I'm a bit frustrated what does it take for me to get a calorie count. Please see previous requests."
4) 10/26/10 The Dialysis Center Dietician's note stated, "I have been asking for several weeks for a calorie count. So far nothing. This is my third note please share note with Dietician. I did ask her a while back via phone. Please have supervisor call me. This is unacceptable!!"
The Registered Nurse (RN) Charge Nurse was interviewed on 11/1/10 at 11:15 AM and stated that she reviews the Dialysis Composition book daily and thought the resident's Dietician was forwarding the information to the Dialysis Center.
The resident's Dietician was interviewed on 11/1/10 at 11:30 AM and stated that she should have sent the information to the Dialysis Center.
The Dialysis Center Dietician was interviewed on 11/1/10 at 2:30 PM and stated that she needed the detailed information from the calorie count to complete her assessment for the resident.
The Director of Nursing (DON) was interviewed on 11/3/10 at 1:45 PM and stated that the information should be available for both the facility and the Dialysis Center.

Automatic sprinklers are required under canopies that are not constructed of non-combustible materials and in which combustible materials are used and stored. Example is the exterior canopy on the 2nd floor outdoor lounge/resident smoking area.
